Hi Folks,
This is my first post. I try to spend more time in my small shop learning this wonderful craft/art form then at the computer, but I need to ask about something that is bothering me.

I have made a few rocking horses for the grand kids and having a blast doing it. A lady that works with my wife at the local VA Hospital asked if I would make one for her kids.

This lady is a nice person and I would like to make a rocking horse for her but I am worried about any liability that may come about.

I am very careful about construction of the rocking horses along with the finishes and even make sure the yarn I use for the mane and tail are made in the USA (no poison Chinese products).

Still, if a child gets hurt on one of my rocking horses (even thru no fault of my own), I am worried that a car full of lawyers will come knocking on my door.

Any of you feel the same ?

It’s always something you have to consider in any business. I’m not and attorney but I might build it and have the buyer sign a statement that the rocking horse is meant for decorative purposes and not as a toy for children.

Some people will sue over anything. I’ve really only made stuff for family. So I might not be the person to ask on this item.

I mean who would put a Wineabago on cruise control and then go to the back to make coffee. They sued and won. So what can I say.

An example in the painful extreme, however…
In this crazy litigation-happy world the nice lady at the hospital could sue for your NOT making the rocking horse for her.

They only hunt where they smell money. You are in just as much danger of someone walking into your shop and tripping over a mouse turd. Enjoying woodworking means sharing it! So share it. You are more likely to be saving the kids from a dangerous product.

Your homeowners policy probably has a little bit of protection if you’re not professional. You can add a $1,000,000 rider for not too much.

on the reciept write a little snippit like Jim says. Not a contract, she’ll run away. But on the reciept you put something like “decrotive rocking horse” as the description. And have her “sign for the price” and you’re covered. don’t put a cruise control on it…..or hot coffee(mcdonalds) and I think you’ll be fine

Anybody can sue anybody for anything. If you let that fear run your life, you’ll be miserable.

Never sold one, but I have made several rocking horses for people. Never thought of a possible lawsuit, just the look on the kids faces when they climb on and ride.

I think Dennis is right, if you don’t have extremely deep pockets then most of the blood sucking sue happy parasites probably won’t bother you. The above description applied to both the lawyers and the clients. Be happy and share your talent. I love making stuff for kids. BTKS
