My question is how tall should it be I want it to pretty universal as far as what beds it can set be side so any advise would be much apprceiated

It depends on the bed height, which can vary a bit. I built a set a few years ago and made them ~ 29” high.

Well is there a rule that says they should be above or below the mattresese?

They should be whatever you find most comfortable. In my experience that means level with the bed and is generally around 29”.
